1. Acceptance of These Terms
By downloading, accessing, or using TongitsSaya ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use the App.
These Terms form a legal agreement between you and INSTANT AI SDN. BHD., the operator of the App. Your use of the App is also subject to any additional policies, guidelines, or rules we may post or provide from time to time, including our Privacy Policy.
2. Eligibility and Accounts
You must be at least 15 years old, or the minimum age required by the law in your jurisdiction, whichever is higher, to use the App.
You may sign in using your Apple, Google, or Facebook account. You are responsible for keeping your login credentials confidential and for any activity that occurs through your account.
You must provide accurate and complete information when creating your account and keep it up to date. You may not create an account on behalf of someone else or use an account belonging to another person without permission.
3. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial entertainment.
You agree not to copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of the App, or to access the App in any way that is not expressly permitted by these Terms.
4. Game Modes and Entertainment Only
TongitsSaya provides card game modes for entertainment purposes only. The App does not offer real-money gambling, wagering, or any opportunity to win prizes of real-world value.
No in-app feature or purchase grants you any chance to receive cash, prizes, or other real-world rewards. Any success within the App reflects your skill in-game and carries no monetary value outside the App.
5. Virtual Coins, Rewards, and Purchases
Coins, diamonds, bonuses, rewards, and other virtual items are provided solely for use within the App. They have no cash value, cannot be redeemed, refunded, withdrawn, or exchanged for real money, gift cards, vouchers, physical goods, or any other real-world value.
Virtual items are non-transferable and may not be sold, traded, or otherwise transferred to other users. Your balance of virtual items is not real property of any kind.
All in-app purchases are processed through the platform's payment system (for example, Apple In-App Purchase). Purchases and refunds are subject to the applicable platform's terms and policies.
6. Fair Play and Prohibited Conduct
To maintain a fair and enjoyable environment, you agree not to:
- Use cheats, bots, scripts, memory editors, modified clients, automation, plug-ins, or unauthorized third-party tools.
- Exploit bugs, reverse engineer the app, interfere with servers, or disrupt the experience of other players.
- Share, rent, sell, or transfer accounts, virtual currency, items, or access rights.
- Create misleading or offensive usernames, abuse support channels, or harass other players or staff.
- Use TongitsSaya for any profit-oriented, illegal, or harmful activity.
7. Account Deletion, Suspension, and Termination
You may delete your account at any time through the App. Deleting your account removes access to it and associated gameplay data, except where retention is required by law or for legitimate security, dispute-resolution, or record-keeping purposes.
We may suspend or terminate your account, or restrict your access to the App, if we reasonably believe you have violated these Terms. If your account is terminated for a violation, you may lose access to virtual items, progress, or other account data without refund.
8. User Content and Public Interactions
You are solely responsible for any content you post, submit, or share through the App. You grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such content as reasonably necessary to operate and improve the App. We may remove content that violates these Terms, applicable law, or community standards.
9. Intellectual Property
The App, including its code, graphics, artwork, sounds, music, game design, trademarks, logos, and all other content, is owned by or licensed to INSTANT AI SDN. BHD. and is protected by intellectual property laws.
Except as expressly permitted by these Terms, you obtain no right, title, or interest in any part of the App or its content. All rights not expressly granted to you are reserved by us and our licensors.
10. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that any data you provide will be preserved without interruption.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTANT AI SDN. BHD. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
12. Changes to the Service and These Terms
We may update, modify, suspend, or discontinue the App, or any feature of it, at any time. We may also revise these Terms from time to time. When we make material changes, we will post the updated Terms in the App or through another reasonable notice method. Your continued use of the App after the updated Terms take effect means you accept the revised Terms.
13. Governing Law and Contact
These Terms are governed by the laws of Malaysia, without regard to its conflict-of-law principles.
